What is the title deed fee

The title deed fee is a transaction charge collected on the transfer of immovable property. Under tariff (4) of the Fees Act No. 492 it is levied at two per cent on the transfer value, separately from the buyer and from the seller, so four per cent in total.

Who pays it

The parties may agree between themselves that one side will bear the whole amount, and in practice the buyer often pays all of it. That agreement binds only the parties: under the statute the buyer and the seller each remain liable for their own share.

What is the fee base

The base is the transfer price declared at the land registry, but it cannot be lower than the property tax assessment value held by the municipality. Where the declared price is lower, the fee is calculated on the assessment value. Declaring a price below the real value carries a risk of a tax assessment with penalty, and it also weakens the buyer position if a dispute later arises over what was actually paid.

What else is payable

Alongside the fee, the Land Registry and Cadastre charges a revolving fund and service amount that is set by tariff and updated every year. Mortgage registration and discharge, changes of designation and succession transactions are charged separately and are not part of the transfer fee.
