Statutory heirs
Under the Turkish Civil Code (TMK), heirs are determined according to a system of parentelic orders. Descendants (children) form the first order; parents and their descendants form the second order; grandparents and their descendants form the third order. If there are heirs in a prior order, the heirs of a subsequent order do not inherit.
The surviving spouse receives 1/4 of the estate when inheriting together with descendants, 1/2 together with the parents’ order, and 3/4 together with the grandparents’ order. If there are no heirs in these orders, the entire estate passes to the spouse.
Reserved portion
The reserved portion is half of the statutory share for descendants and one quarter for each parent. The surviving spouse’s reserved portion is the entire statutory share when inheriting together with descendants or the parents’ order, and three quarters in other cases.
