Pecuniary damages in bodily injury
Under Articles 54–55 of the Turkish Code of Obligations, pecuniary damages for bodily injury include medical expenses, loss of earnings, loss of future earning capacity and losses arising from impaired economic prospects.
Temporary and permanent incapacity
Loss of earnings during temporary incapacity is calculated on the basis of net earnings for the period of medical leave. Compensation for permanent disability is calculated by an expert using the disability rate, the injured party’s age, life expectancy and actuarial tables.
