What is diminished value?

Diminished value is the gap that remains between a vehicle's second-hand market value before and after an accident, even where the repair has been carried out properly. Turkish law treats it as a separate head of loss, claimable from the at-fault driver's motor third-party liability insurer or from the driver directly.

How is it determined?

There is no statutory formula. The amount is determined by an expert report, starting from the gap between the market value before the accident and the post-repair “accident-recorded” market value, and taking into account the make and model, age, mileage, the nature of the damage and any previously recorded damage.

What does this tool do?

The tool does not produce a single figure. It first assesses whether anything stands in the way of the claim (fault, the write-off threshold, whether the vehicle has been repaired), then gives a range together with the factors that strengthen or limit the claim and the route the application should follow. The result does not replace an expert report.

Route and time limit

The claim is made first to the insurer; if it is refused or unanswered, the matter may go to the Insurance Arbitration Commission or to court. Tort claims must be brought within two years of learning of the loss and the responsible party, and in any event within ten years of the act (Turkish Code of Obligations Art. 72).
