Limitation and preclusive periods

A limitation period does not extinguish the right itself but allows the debtor to refuse performance; it must be raised by the opposing party. Preclusive periods, such as the time limit for filing an administrative action, extinguish the right when missed and are considered by the court of its own motion.

How the periods are counted

Periods expressed in years or months end on the day corresponding to the start date. Where a procedural deadline ends on a public holiday, it is extended to the next working day. Limitation is interrupted by filing suit, starting enforcement proceedings or acknowledgment of the debt.
