Statutory limit on rent increases
Under Article 344 of the Turkish Code of Obligations (TBK), the increase applied in renewed rental periods may not exceed the rate of change in the twelve-month average consumer price index for the preceding rental year. This rule applies to leases of residential and roofed commercial premises.
If a lower increase rate has been agreed in the contract, the contractual rate applies.
Leases exceeding five years
For leases lasting longer than five years and for rental periods renewed after the fifth year, the rent may be determined by the judge on an equitable basis, taking comparable rents into account.
