Steps in a reinstatement claim
An employee who considers the termination invalid must apply to a mediator within one month of receiving the termination notice. If no settlement is reached, the reinstatement action must be filed within two weeks of the final mediation report.
Once the reinstatement judgment becomes final, the employee must apply to the employer within ten working days of service of the judgment. The employer must reinstate the employee within one month; otherwise, compensation for job security and idle-period wages become payable.
